兩者之間的差別在于adjudicative fact (爭(zhēng)議事實(shí),訴爭(zhēng)事實(shí))是指訴訟,尤其是行政裁決程序中與當(dāng)事人具體相關(guān)的事實(shí),如個(gè)人動(dòng)機(jī)、故意等,其為個(gè)案屬性[1]。
而legislative fact (立法事實(shí))則泛指與案件具體當(dāng)事人的個(gè)人問(wèn)題無(wú)關(guān),即不屬于個(gè)案性質(zhì)而屬于法律規(guī)定的具有一般屬性的社會(huì)、經(jīng)濟(jì)、科 技等的事實(shí)問(wèn)題,
其只在幫助法定或行政機(jī)關(guān)決定該立法的內(nèi)容及適用范疇[2]。
