兩個(gè)術(shù)語(yǔ)之間的區(qū)別在于arrest warrant為“逮捕狀”（也稱(chēng)為warrant of arrest)，指由相關(guān)的權(quán)力機(jī)構(gòu)，如法官或地方行政官所簽發(fā)，授權(quán)逮捕某人或搜查某地的命令[1]。bench warrant 則為“法庭拘傳令”，指由法院簽發(fā)，授權(quán)拘捕某人的令狀，其多在蔑視法庭、證人拒絕接受傳喚或收到刑事起訴書(shū)不出庭等 情況適用[2]。此處的 bench 等同 court considered in its official capacity。
