以上這些單詞均有扣押財產(chǎn)的含義。其中,detention多指非法扣押他人財產(chǎn),與detainer同義,常為一種違法(wrongful) 行為[1]。attachment是指得到法院的命令且由法庭官員予以執(zhí)行的對債務(wù)人財產(chǎn)的扣押,如防止被告轉(zhuǎn)移財產(chǎn)或迫使其到庭解決債務(wù)糾紛等[2]。garnishment 是指對第三人保管的債務(wù)財產(chǎn)之扣押,包括對債務(wù)人的工資的扣押,目的是用其償還債務(wù)[3]。 capture為“捕獲”,多用于國際法中,指交戰(zhàn)國扣押敵國或載有應(yīng)予沒收貨物的中立國船舶的權(quán)利,以及交戰(zhàn)國對陸地上非私人財產(chǎn)(即戰(zhàn)利品)的扣押;在民法中,其指捕獲不屬于他人的魚類、飛禽和野獸從而獲得該財產(chǎn)的一種方式 [4]。levy是指執(zhí)行判決扣押債務(wù)人之動產(chǎn)或不動產(chǎn),同時拍賣以償還債務(wù) (也稱為levy of execution) [5]。seizure則是指因違法或執(zhí)行判決等扣押財產(chǎn)的行為[6];其與capture的區(qū)別在于capture是由軍隊實施的,而seizure則是由文職政權(quán)實施的[7]。distress是指扣押債務(wù)人之動產(chǎn)(goods)以還債,尤指地主(房東)扣押財產(chǎn)以 求佃戶(房客)償還租金[8]。
