Duty of the Insured
It is the duty of the insured to attend to all matters as specified hereunder, failing which the company reserves the right to reject his claim for any loss if and when such failure prejudice the rights of the Company:
1. The insured shall take delivery of the insured goods in good time upon their arrival at the port of destination named in the Policy. In the event of any damage to the goods, the insured shall immediately apply for survey to the survey and/or settling agent stipulated in the Policy. If the insured goods are found short in entire package or packages or to show apparent traces of damage, the insured shall obtain from the Carrier, bailed or other relevant authorities certificate of loss or damage and/or shorthand memo. Should the carrier, bailed or the other relevant authorities be responsible for such shortage, the insured shall lodge a claim with them in writing and, if necessary, obtain their confirmation of an extension of the time limit of validity of such claim.
2. The insured shall, and the Company also, take reasonable measures immediately in salvaging the goods or preventing or minimizing a loss or damage thereto. The measures so taken by the insured or by the Company shall not be considered respectively, as a waiver of abandonment hereunder, or as an acceptance thereof.
3. In case of a change of voyage or any omission or error in the description of the interest, the name of the vessel or voyage, this insurance shall remain in force only upon prompt notice to this Company when the insured becomes aware of the same and payment of an additional premium if required.
4. The following documents should accompany any claim hereunder made against this Company:
Original Policy, Bill of Lading, Invoice, Packing List, Weight Memo, Certificate of Loss or Damage and/or Shorthand Memo, Survey Report, Statement of Claim.
If any third party is involved, documents relative to pursuing of recovery from such party should also be included.

被保險(xiǎn)人應(yīng)按照以下規(guī)定的應(yīng)盡義務(wù)辦理有關(guān)事項(xiàng),如因未履行規(guī)定的義務(wù)而影響保險(xiǎn)人利益時(shí),本公司對有關(guān)損失有權(quán)拒絕賠償。
(一)當(dāng)被保險(xiǎn)貨物運(yùn)抵保險(xiǎn)單所載明的目的港(地)以后,被保險(xiǎn)人應(yīng)及時(shí)提貨,當(dāng)發(fā)現(xiàn)被保險(xiǎn)貨物遭受任何損失,應(yīng)立即向保險(xiǎn)單上所載明的檢驗(yàn)、理賠代理人申請檢驗(yàn),如發(fā)現(xiàn)被保險(xiǎn)貨物整件短少或有明顯殘損痕跡應(yīng)立即向承運(yùn)人、受托人或有關(guān)當(dāng)局索取貨損貨差證明。如果貨損貨差是由于承運(yùn)人、受托人或其他有關(guān)方面的責(zé)任所造成,應(yīng)以書面方式向他們提出索賠,必要時(shí)還須取得延長時(shí)效的認(rèn)證。
(二)對遭受承保責(zé)任內(nèi)危險(xiǎn)的貨物,被保險(xiǎn)人和本公司都可迅速采取合理的搶救措施,防止或減少貨物的損失,被保險(xiǎn)人采取此項(xiàng)措施,不應(yīng)視為放棄委付的表示,本公司采取此項(xiàng)措施,也不得視為接受委付的表示。
(三)如遇航程變更或發(fā)現(xiàn)保險(xiǎn)單所載明的貨物、船名或航程有遺漏或錯(cuò)誤時(shí),被保險(xiǎn)人應(yīng)在獲悉后立即通知保險(xiǎn)人并在必要時(shí)加繳保險(xiǎn)費(fèi),本保險(xiǎn)才繼續(xù)有效。
(四)在向保險(xiǎn)人索賠時(shí),必須提供下列單證:
保險(xiǎn)單正本、提單、發(fā)票、裝箱單、磅碼單、貨損貨差證明、檢驗(yàn)報(bào)告及索賠清單。如涉及第三者責(zé)任,還須提供向責(zé)任方追償?shù)挠嘘P(guān)函電及其他必要單證或文件。

理賠代理人 (Settling Agent)
代理保險(xiǎn)公司從事賠款處理的工作人員被稱為理賠代理人。他的權(quán)力由保險(xiǎn)人予以規(guī)定,代理人的行為就是所代理的保險(xiǎn)人的行為。在規(guī)定的權(quán)限內(nèi),如有違法保險(xiǎn)人的指定事項(xiàng)而導(dǎo)致?lián)p失時(shí),理賠代理人須承擔(dān)賠償責(zé)任。
