中國(guó)現(xiàn)行憲法在保持穩(wěn)定的同時(shí),隨著改革開(kāi)放和社會(huì)主義現(xiàn)代化建設(shè)事業(yè)的推進(jìn)而與時(shí)俱進(jìn)、不斷完善,及時(shí)將實(shí)踐證明是成熟的重要經(jīng)驗(yàn)、原則和制度寫(xiě)入憲法,充分體現(xiàn)了中國(guó)改革開(kāi)放的突出成果,體現(xiàn)了中國(guó)特色社會(huì)主義建設(shè)事業(yè)的偉大成就,體現(xiàn)了社會(huì)主義制度的自我完善和不斷發(fā)展,為改革開(kāi)放和社會(huì)主義現(xiàn)代化建設(shè)提供了根本保障。
中國(guó)憲法在中國(guó)特色社會(huì)主義法律體系中具有最高的法律效力,一切法律、行政法規(guī)、地方性法規(guī)的制定都必須以憲法為依據(jù),遵循憲法的基本原則,不得與憲法相抵觸。
The Constitution has supreme legal authority in the socialist system of laws with Chinese characteristics. All laws, administrative and local regulations must be made in accordance with the Constitution and follow its basic principles, and must not contravene the Constitution.
The laws are the main body of the socialist system of laws with Chinese characteristics. The Constitution stipulates that the NPC and its Standing Committee exercise the legislative power of the state. The laws formulated by the NPC and its Standing Committee are the main body of the socialist system of laws with Chinese characteristics, and deal with matters of fundamental and overall importance to national development and those which affect the country's stability and long-term development. The laws are the basis of the nation's legal system, and must not be contravened by administrative or local regulations.
法律是中國(guó)特色社會(huì)主義法律體系的主干。中國(guó)憲法規(guī)定,全國(guó)人大及其常委會(huì)行使國(guó)家立法權(quán)。全國(guó)人大及其常委會(huì)制定的法律,是中國(guó)特色社會(huì)主義法律體系的主干,解決的是國(guó)家發(fā)展中帶有根本性、全局性、穩(wěn)定性和長(zhǎng)期性的問(wèn)題,是國(guó)家法制的基礎(chǔ),行政法規(guī)和地方性法規(guī)不得與法律相抵觸。
立法法規(guī)定了全國(guó)人大及其常委會(huì)的專(zhuān)屬立法權(quán)。全國(guó)人民代表大會(huì)制定和修改刑事、民事、國(guó)家機(jī)構(gòu)的和其他的基本法律;全國(guó)人民代表大會(huì)常務(wù)委員會(huì)制定和修改除應(yīng)當(dāng)由全國(guó)人民代表大會(huì)制定的法律以外的其他法律,在全國(guó)人民代表大會(huì)閉會(huì)期間,可以對(duì)全國(guó)人民代表大會(huì)制定的法律進(jìn)行部分補(bǔ)充和修改,但不得同該法律的基本原則相抵觸。立法法還規(guī)定,對(duì)國(guó)家主權(quán)的事項(xiàng),國(guó)家機(jī)構(gòu)的產(chǎn)生、組織和職權(quán),民族區(qū)域自治制度、特別行政區(qū)制度、基層群眾自治制度,犯罪和刑罰,對(duì)公民政治權(quán)利的剝奪、限制人身自由的強(qiáng)制措施和處罰,對(duì)非國(guó)有財(cái)產(chǎn)的征收,民事基本制度,基本經(jīng)濟(jì)制度以及財(cái)政、稅收、海關(guān)、金融和外貿(mào)的基本制度,訴訟和仲裁制度等事項(xiàng),只能制定法律。
The Law on Legislation ensures exclusive legislative power to the NPC and its Standing Committee. The NPC enacts and amends basic laws governing criminal offences, civil affairs, state organs and other matters; the Standing Committee of the NPC enacts and amends laws other than the ones to be enacted by the NPC. When the NPC is not in session, it may supplement and amend laws enacted by the NPC, but must not contradict the basic principles of such laws. The Law on Legislation also stipulates that the following must be governed by law: affairs concerning state sovereignty; formation, organization, and functions and powers of state organs; the system of regional ethnic autonomy; the system of special administrative regions; the system of primary-level self-governance; criminal offences and their punishment; mandatory measures and penalties involving deprivation of citizens' political rights or restriction of the freedom of the person; requisition of non-state-owned property; basic civil system; basic economic system; basic systems of fiscal administration, taxation, customs, finance and foreign trade; systems of litigation and arbitration; and other affairs.
The laws enacted by the NPC and its Standing Committee establish the important and basic legal systems in the nation's economic, political, cultural, social and ecological civilization construction, are the main body of the socialist system of laws with Chinese characteristics and provide an important basis for the formulation of administrative and local regulations. Administrative regulations are an important component of the socialist system of laws with Chinese characteristics. The State Council formulates administrative regulations in accordance with the Constitution and laws, which is an important form of the State Council's implementation of its responsibility endowed by the Constitution and laws. The administrative regulations may regulate matters concerning the implementation of the provisions of the laws and performance of the administrative functions and powers of the State Council. For matters that shall be governed by laws to be formulated by the NPC and its Standing Committee, the State Council may enact administrative regulations first in its place with authorization from the NPC and its Standing Committee. The administrative regulations occupy an important position in the socialist system of laws with Chinese characteristics by detailing the related systems stipulated by laws, elaborating and supplementing the laws.
