長期以來，在法律英語中，存在著嚴重濫用shall —詞的情況, 無論外國法律，述是中國法律英譯均是如此。對此，英語國家巳經(jīng)開始給予應有注意。美國簡明英語行動和信息網(wǎng)出版的寫作手冊 Writing User-friendly Documents以及美國國家檔案和記錄管理局出版的寫作手冊Drafting Legal Documents中，專門對法律文件中shall等情態(tài)動詞的用法作出說明：
Use“must”for obligation, “may”for permission, and“should”for preference. Use“may not”to convey prohibitions. Avoid the ambiguous“shall. ”
Writing User-friendly Documents
Shall-imposes an obligation to act, but may be confused with prediction of future action
Will—predicts future action
Must—imposes obligation, indicates a necessity to act
Should一infers obligation, but not absolute necessity
May——indicates discretion to act?
May not—indicates a prohibition

A: The Governor shall approve it.
B: The Governor must approve it. 【表示義務】
C: The Governor will approve it.【表示未來行動】
