分析:第一個(gè)shall不可能表示“必須”(意思不通),所以不能換成must;換成will又不符合法律使用一般現(xiàn)在時(shí)的原則,所以只能換成is;第二個(gè)shall 表示應(yīng)當(dāng)(必須),所以,要譯為must。
擬譯:
A contract drawn up in accordance with the law is legally binding upon the parties. A party must perform its obligations in accordance with the contract, and may not arbitrarily modify or terminate the contract.
旁證:A contract validly entered into is binding upon the parties. It can only be modified or terminated in accordance with its terms or by agreement or as otherwise provided in these Principles.

如果像原譯那樣,用否定的表達(dá)方法,應(yīng)該說No marriage may be contracted... ,而不是 shall be...。
