至于什么情況下采用直譯的方法，筆者認為美國翻譯家奈達對形式和內(nèi)容關系的處理方法所提出的改變語言形式的五個條件很有借鑒意義：（1)直譯會導致意義上的錯誤時；（2)引入外來語形成語義空白（semantic zero),讀者有可能自己填入錯誤的意義時；（3)形式對等引起嚴重的意義晦澀時；（4)形式對等引起作者原意所沒有的歧義時；（5)形式對等違反譯人語的語法或文體規(guī)范時。
國際商務法律文獻翻譯過程中，同樣可以參照以上原則，即：盡可能直譯，直譯不妥時便意譯。在實際的商務法律文獻的翻譯中，直譯和意譯兩種方法交叉使用。 這兩種翻譯方法的使用目的就是要達到信息對等的目的。例如：
Article 3
This Convention shall apply ：
1. With regard to compensation, according to Article 4, exclusively to pollution damage caused on the territory including the territorial sea of Contracting State, and to preventive measures taken to prevent or minimize such damage；
2. With regard to indemnification of shipowners and their guarantors according to Article 5, exclusively in respect of pollution damage caused on the territory, including the territorial sea of a State Party to the Liability Convention by a ship registered in or flying the flag of a Contracting State and in respect of preventive measures taken to prevent or minimize such damage.
第三條
本公約適用于：
（1）關于按照第四條的賠償，專指在締約國領土包括領海上造成的油污損害和為防止或減少這種損害而采取的預防措施。
（2）關于按照第五條規(guī)定對船舶所有人及其保證人的補償，專指在責任公約締約國的領土，包括領海上由另一締約國所登記的船舶或是掛該國國旗的船舶造成的損害，和為防止或減少這種損害而采取的預防措施。
